Background
The Supreme Court ruled that the refund of bride price by the woman’s parents
or relatives upon a failed marriage is unconstitutional. The judgment of
the court arose from an appeal for the abolition of bride price that MIFUMI, a
non-governmental organization, and 12 others lost before the Constitutional
Court in 2010.
MIFUMI had petitioned the Constitutional Court to abolish bride price saying
that the customary practice was responsible for the rising cases of domestic
violence, HIV/AIDS and early marriages.
